Purchasing a Residential Property
Buying a home is a major financial decision, and it requires great attention to detail and careful handling. We can help by preparing and/or reviewing your Offer to Purchase to ensure a smooth process and identify any issues that may exist with the property before you fully commit to closing the deal. Alternatively, if you come to our office with an already accepted Offer to Purchase, we will take all the steps necessary to protect your interests while closing the transaction.
Selling your Home
A person’s home is often one of the most significant assets that they possess. It is important to acquire dependable legal advice to ensure all necessary steps in your sale are completed. Our lawyers and staff are able to assist you at any point during the process to help your transaction reach a successful conclusion.
Purchasing and Selling Commercial Property
Commercial purchase and sale transactions can be complicated and there are many factors to consider prior to closing the deal. There are significant investigations for any potential Purchaser of Commercial Property to consider. Conversely any potential Seller should be wary of what representations and warranties they are prepared to provide to a Purchaser. Please arrange a consultation with one of our lawyers if you are considering purchasing or selling Commercial Property.
Wills & Estate Planning
One important document that every adult should have in place is a Will. A Will outlines your wishes in the event of your death and appoints an Executor or Trustee to ensure those wishes are carried out in accordance with your instructions. It is important to note that Wills and any changes to a Will are required to be signed in accordance with the rules of the Court. Our lawyers are familiar with these rules and can ensure your Will is executed properly.
A Power of Attorney and a Health Care Directive are also essential documents to discuss when planning for the future. These are two separate documents. The Power of Attorney appoints an individual or individuals to handle your financial affairs. Similarly, a Health Care Directive appoints an individual or individuals to make decisions regarding your health and medical care if you cannot do so for yourself.
Our office offers support and reliable advice to assist you in meeting your specific needs when you are establishing your estate plan. Our office can assist you with:
- Wills and Codicils (Changes to existing Wills)
- Powers of Attorney
- Health Care Directives (also known as Living Will)
- Planning for Estate Taxes
- Estate Freezes
- Joint Property Transfers
Estate Administration & Probate
Our knowledgeable lawyers can assist you with an application for Probate or Administration.
- Preparing an Application for Probate or Letters of Administration
- Transmission of Land from the Deceased to the Estate
- Estate Transfers of Land
- Administration of Estate
If an individual passes away with a Will in place, the Executor may need to apply for Probate depending on the value of the Estate’s assets and how they are held. Probate is essentially the Judge of the Court approving the Will as a valid Will. Whether or not you require Probate usually depends on the financial institutions and insurance companies involved as well as if there is any real property held by the deceased. In order to apply for Probate you must have the original signed Will and submit it with an application and the applicable fees to the Court.
If a person passes away without a Will in place and it is determined that Letters of Administration are required to handle the assets of the Estate, a person approved by the Court must apply to be the administrator of the estate, usually a family member. An application for Administration must be completed and submitted to the court for approval. If an individual passes away with a Will but the Will does not appoint an executor or the appointed executor is no longer living or able to act, an application for Letters of Administration with the Will attached must be submitted to the Court.
